Terms of Service

These Terms of Service ("Terms") govern your use of Eva, an AI-powered personal assistant application ("the Service"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

Eva is a personal productivity assistant that provides email management, task tracking, bill monitoring, meal logging, news curation, and other features. The Service uses artificial intelligence to classify, summarize, and extract information from your data to provide useful insights and automation.

2. Account and Security

• You are responsible for maintaining the confidentiality of your account PIN and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• You must provide accurate information when creating your account.
• You must be at least 13 years of age to use the Service.

3. Gmail Integration

Eva integrates with Gmail through Google's OAuth 2.0 authorization. By connecting your Gmail account:

• You grant Eva read-only access to your email messages. Eva cannot send, delete, or modify your emails.
• You acknowledge that email content (subject lines, sender information, snippets, and body text) may be sent to third-party AI services (OpenAI, Anthropic) for classification and summarization, as described in our Privacy Policy.
• You can revoke Gmail access at any time through the app's Settings or through your Google Account permissions.
• Eva is not responsible for the availability, accuracy, or security of the Gmail API or Google's services.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the Service, other accounts, or our server infrastructure.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Use the Service to transmit malware, spam, or other harmful content.
• Share your account credentials with others or allow multiple individuals to use a single account.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Email classifications, summaries, bill extractions, or other AI-generated content will be accurate or complete.
• The Service will meet your specific requirements.
• Any defects in the Service will be corrected.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVA AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or unauthorized access to your accounts or personal information.
• Security breaches or data breaches affecting the Service or connected third-party services.
• Missed bill payments, appointments, or deadlines due to incorrect or missing email classifications, notifications, or task creation.
• Financial loss arising from reliance on AI-generated bill information or financial summaries.
• Damages resulting from the unavailability or malfunction of the Service.
• Any actions taken by third-party AI services (OpenAI, Anthropic) in processing your data.

In no event shall our total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

7. Account Security Disclaimer

While we implement reasonable security measures to protect your data, you acknowledge that:

• No method of electronic storage or transmission is 100% secure.
• You are solely responsible for maintaining the security of your PIN and account credentials.
• We are not liable for unauthorized access resulting from compromised, shared, or weak credentials.
• We are not liable for unauthorized access resulting from vulnerabilities in your device, operating system, or network.

8. Indemnification

You agree to indemnify and hold harmless Eva and its developer from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Termination

• You may stop using the Service at any time by deleting your account.
• We may terminate or suspend your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
• Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
